1. AGREEMENT TO TERMS

These Terms of Use ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Dalmik, LLC d/b/a BioStacking Experience ("Company," "we," "us," or "our").

These Terms govern your access to and use of the BioStacking Experience website, membership portal, AI-powered tools, digital content, live and recorded events, courses, downloads, community features, and all related services (collectively, the "Platform").

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you must not access or use the Platform.

2. EDUCATIONAL PURPOSE ONLY – NO MEDICAL ADVICE

BioStacking Experience is an educational wellness platform. The Platform does NOT provide medical advice, diagnose, treat, cure, or prevent any disease, or create a doctor-patient relationship. All content is for educational and informational purposes only.

Always consult a licensed healthcare professional before beginning any protocol, using medical or wellness devices, taking supplements, adjusting medications, or implementing lifestyle changes.

YOU ACKNOWLEDGE THAT ANY RELIANCE ON CONTENT PROVIDED THROUGH THE PLATFORM IS AT YOUR SOLE RISK.

3. AI TOOL DISCLAIMER

The Platform may include AI-powered search or content tools. These tools generate automated responses that may be inaccurate, incomplete, or outdated. The AI system is NOT a licensed medical provider. AI responses are for informational purposes only.

You agree not to rely on AI output as medical, legal, or professional advice. We disclaim all liability arising from AI-generated responses.

4. MEMBERSHIP & ACCOUNT TERMS

4.1 Account Creation

You may be required to create an account. You agree to provide accurate information, maintain the confidentiality of your login credentials, not share your account with others, and notify us of any unauthorized access. You are responsible for all activity under your account.

4.2 Subscription & Billing

If you enroll in a paid membership, fees will be disclosed at checkout. Subscriptions may auto-renew and you authorize recurring billing. Cancellation must occur before the renewal date. Unless otherwise required by law, fees are non-refundable. Failure to pay may result in suspension or termination.

4.3 Promotional Pricing

Promotional or founding member pricing may be time-limited, may convert to standard pricing, and may include limited benefits. We reserve the right to modify or discontinue promotional programs at any time.

5. SMS / TEXT MESSAGING TERMS

By opting in to SMS communications from Dalmik, LLC d/b/a BioStacking Experience, you agree to the following terms:

Program Description: BioStacking Experience provides SMS communications including summit registration confirmations, session reminders, account updates, special offers, discounts, and service updates to opted-in subscribers.

Age Restriction: By opting in to receive SMS messages from BioStacking Experience, you confirm that you are 18 years of age or older.

Opt-Out: You can cancel the SMS service at any time. Text STOP to any message from us. After sending STOP, we will confirm your unsubscription and no further messages will be sent. To re-subscribe, sign up again through our opt-in form.

Message Frequency: Message frequency may vary depending on your opt-in selections and platform activity.

Message & Data Rates: Message and data rates may apply for messages sent to you from us and from you to us. If you have questions about your text plan or data plan, contact your wireless provider.

Carriers are not liable for delayed or undelivered messages.

6. INTELLECTUAL PROPERTY

All Platform content — including videos, courses, transcripts, designs, branding, logos, AI training content, downloads, documents, and community materials — is owned by or licensed to the Company.

You may not copy, record, download for redistribution, re-sell, share login credentials, upload content elsewhere, or screen record paid material. Unauthorized use may result in account termination, legal action, and financial damages.

7. USER CONDUCT

You agree not to provide medical advice to other users, harass or threaten others, upload harmful software, violate intellectual property rights, impersonate others, use scraping or automated extraction tools, or share copyrighted materials without authorization.

We reserve the right to remove content, suspend accounts, terminate memberships, and block access at our sole discretion.

8. COMMUNITY & CONTRIBUTIONS

You may submit comments, messages, testimonials, feedback, and community posts. By submitting, you grant the Company a worldwide, royalty-free license to use, display, reproduce, and distribute your contributions in connection with the Platform. You represent that you own or have the rights to your submissions. We may remove content at our discretion.

9. THIRD-PARTY LINKS & AFFILIATES

The Platform may contain links to affiliate partners, sponsors, product providers, and external websites. We may receive commissions from affiliate purchases. We do not guarantee the accuracy or safety of third-party products or services. Any transaction with third parties is solely between you and them.

10. EVENTS & RECORDINGS

Live sessions may be recorded. By participating in live events, you consent to recording, distribution, replay usage, and marketing usage of those recordings. If you do not consent, do not participate in live sessions or disable your video and microphone where possible.

11. LIMITATION OF LIABILITY

To the maximum extent permitted by law, the Company shall not be liable for personal injury, health outcomes, indirect damages, lost profits, loss of data, emotional distress, device misuse, community disputes, third-party actions, or AI-generated errors.

YOUR USE OF THE PLATFORM IS AT YOUR SOLE RISK. OUR MAXIMUM LIABILITY SHALL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID IN THE PRIOR 12 MONTHS OR $100 USD.

12. DISCLAIMER OF WARRANTIES

The Platform is provided "as is" and "as available." We make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or error-free operation. We do not guarantee uninterrupted service.

13. INDEMNIFICATION

You agree to indemnify and hold harmless the Company from any claims arising from your misuse of the Platform, your violation of these Terms, your reliance on content, your sharing of advice with others, or your breach of applicable law.

14. FORCE MAJEURE

We are not liable for delays or failures caused by internet outages, platform disruptions, acts of God, government restrictions, or third-party service failures beyond our reasonable control.

15. TERMINATION

We may terminate your account if you violate these Terms, share account access, misuse content, or disrupt the community. Termination does not entitle you to refunds unless required by applicable law.

16. PRIVACY

Your use of the Platform is governed by our Privacy Policy, available at https://biostacking.com/privacy-policy. By using the Platform, you consent to our data practices as described in that Policy.

17. ARBITRATION & CLASS ACTION WAIVER

Any dispute arising under these Terms shall be resolved by binding arbitration under the laws of the State of California. You agree to waive the right to a jury trial and to waive participation in class actions. Disputes shall be resolved individually.

18. GOVERNING LAW

These Terms are governed by the laws of the State of California, USA. All disputes shall be resolved in California courts unless arbitration applies.

19. SEVERABILITY

If any provision of these Terms is found to be unenforceable, the remainder shall continue in full force and effect.

20. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, constitute the entire agreement between you and the Company regarding your use of the Platform and supersede all prior agreements.
